A proposta da redução da maioridade penal de 18 para 16 anos, para além de não resolver o problema da impunidade, retrocede nas conquistas históricas e sociais da população brasileira em que concerne a garantia dos Direitos Humanos da Criança e do Adolescente.
Utilizar o sistema penitenciário para adolescentes em conflito com a lei, não garante reinserção e reeducação, muito menos a diminuição da violência, porque, a perspectiva não é de trabalhar com sua inserção na sociedade e sim apenas com a punição.
O que precisamos analisar é que o jovem em conflito com a lei, principalmente o que comete atos infracionais com frequência, é, sobretudo alguém que não acredita nem legitima a figura do Estado. Por isso, se faz necessário destacar que a questão passa além das evidências jurídicas.
Contudo, a lei unicamente não tem força suficiente que consiga suprimir toda a demanda da sociedade, que envolve a precariedade em diversos aspectos, seja ele cultural ou histórico. O que exige atenção do Estado e evidência a necessidade da efetivação das políticas públicas e sociais.
Portanto, devemos buscar e priorizar a efetivação e o aprimoramento do sistema atual de medidas socioeducativas que, junto com o Sistema Nacional de Atendimento Socioeducativo (Sinase), trabalhando com a educação e autonomia, poderemos conscientizar o adolescente do seu ato infracional, fazendo a sua integração frente a sociedade.
Assim, conclamamos que as organizações e pessoas aliadas façam mobilização nas redes sociais para o envio de mensagens às(aos) senadoras(es) solicitando sua articulação contra a redução da maioridade penal.
