A criminalidade juvenil é um fenômeno que tem crescido muito nos últimos anos, segundo notícias que recebemos da mídia. Diz-se juvenil, pois são retratados aqui adolescentes e jovens com menos de 18 anos, que, por não serem legalmente maiores de idade, têm uma punição diferente dos adultos. Temos então crimes envolvendo jovens aumentando exponencialmente, uma mídia sensacionalista que prega ódio e vingança para com os jovens suspeitos de crimes, e uma população indignada com a sociedade violenta em que está inserida: Um prato cheio para se pensar em um projeto de emenda da Constituição sobre a redução da maioridade penal.
Esta proposta de emenda não é de hoje, ela foi primeiramente apresentada em 1993, pelo deputado Benedito Domingos PP/DF. Ela defendia, assim como ainda hoje, a alteração do artigo 225 da Constituição Federal, que trata da inimputabilidade do jovem de 18 anos, – “Art. 228. São penalmente inimputáveis os menores de dezoito anos, sujeitos às normas da legislação especial.” – ou seja, o jovem não responde pelo ato cometido como crime, mas sim como infração penal. O que se procura analisar neste artigo é a constitucionalidade (ou não) desta proposta, e os efeitos que, se aprovada, essa emenda traria à sociedade.
Primeiramente, é necessário saber o que são cláusulas pétreas e qual o seu objetivo: “Dispositivo constitucional imutável, que não pode sofrer revogação. Seu objetivo é o de impedir que surjam inovações temerárias em assuntos cruciais para a cidadania e para o Estado. A Constituição Federal determina que a proposta de emenda constitucional tendente a abolir este preceito não será objeto de deliberação.” Portanto, observa-se que há matérias que não podem ser objeto de emendas constitucionais, como estabelecido no artigo 60, §4º da Carta Magna:
“Art. 60. A Constituição poderá ser emendada mediante proposta:
- 4º – Não será objeto de deliberação a proposta de emenda tendente a abolir:
I – a forma federativa de Estado;
II – o voto direto, secreto, universal e periódico;
III – a separação dos Poderes;
IV – os direitos e garantias individuais.“
Conforme verificado no inciso IV, os direitos e garantias individuais são invioláveis, ou seja, a inimputabilidade penal, por se manifestar como uma garantia de direitos para pessoas menores de 18 anos de idade, compreende-se como uma cláusula pétrea.
Além dessa suposta inconstitucionalidade do projeto de emenda, é necessário também analisar a sua funcionalidade e sua real necessidade. Atualmente, crianças e adolescentes estão sobre proteção do Estatuto da Criança e do Adolescente (ECA), Lei nº 8.069/90, que é um importante instrumento nas mãos do estado, haja vista que jovens menores de 18 anos possuem personalidade, intelecto e caráter ainda em desenvolvimento. A partir dos 12 anos, qualquer pessoa que cometa um ato ilegal perante a lei é responsabilizado pelo mesmo. O ECA prevê diversas medidas educativas, desde advertências e prestações de serviço à comunidade, até a internação, que é o grau máximo. Ou seja, o que podemos concluir disso é que já existem leis para menores de idade, o que falta é ela ser cumprida. Reduzir a maioridade penal seria uma forma de isentar o Estado da responsabilidade que tem com a juventude brasileira, a partir do momento em que esse Estado que deveria garantir direitos fundamentais como saúde, educação e moradia, passa a ser um Estado penal, em que se gasta mais dinheiro na construção de presídios do que construindo escolas.
Os atos infracionais cometidos por adolescentes ainda é, e continuará a ser um problema no Brasil. O que se deve ser analisado é se a redução da maioridade penal irá, de fato, diminuir essa taxa. Ao contrário do que se pensa, estudos apontam que não há relação direta entre ações punitivas e repressivas por parte do Estado e a redução do número de crimes. O que realmente impacta na diminuição do crime é a ação do Estado na implementação de políticas públicas voltadas aos jovens, ou seja, o que temos no panorama nacional é um tratamento do efeito e não da causa.
